These Terms & Conditions (“Terms”) apply to your use of newtronx.com and to every order you place with us. Newtronx (“Newtronx,” “we,” “us” or “our”) is operated by Elaine and Associates, LLC, 25157 SW 108th Ct, Homestead, FL 33032, United States. By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

1. Who can order

You must be at least 18 years old to place an order. We sell and ship within the United States only. You agree that the information you give us at checkout is accurate and complete.

2. Products and descriptions

We try to describe and photograph our products as accurately as possible, including age range, weight limit, dimensions and what is included. Colors may look slightly different depending on your screen. If a product is not as described, your remedy is to return it under our Shipping & Return Policy.

3. Prices, payment and sales tax

• All prices are in US dollars and can change at any time before you place your order.
• Payment is taken at checkout through our payment processor. We do not store your full card number.
• Sales tax is added at checkout where we are required to collect it, based on your delivery address. The exact amount is shown before you pay.
• If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel the order and refund you in full.

4. Orders and acceptance

After you order, we send a confirmation email. We reserve the right to refuse or cancel an order, for example if an item is out of stock, if there is an error in the price or description, or if we suspect fraud. If we cancel an order you have paid for, we refund the full amount to your original payment method.

5. Shipping and delivery

Shipping areas, costs, processing times and delivery estimates are described in our Shipping & Return Policy. Delivery dates are estimates and are not guaranteed. Please make sure your shipping address is correct and that someone can receive the package.

6. Returns, refunds and warranty

Returns, refunds and our one-year limited warranty are governed by our Shipping & Return Policy, which is part of these Terms.

7. Safe use of our products

Our riding products are designed for young children and must always be used under close adult supervision. Before use, an adult must assemble the product following the included instructions and check that every part is secure. Always follow the age range, the maximum weight and the warnings shown on the product page, the packaging and the instruction manual, and use the safety harness as instructed. Never let a child ride near streets, driveways, stairs, slopes, pools or other hazards. Stop using the product and contact us if any part is damaged or missing.

8. Coupons and promotions

Coupon codes have no cash value, can be used once per customer unless we say otherwise, and cannot be combined with other coupon codes. We may change or end a promotion at any time, but this will not affect orders already placed.

9. Your account

You can check out as a guest or create an account. If you create an account, you are responsible for keeping your password confidential and for activity under your account. Tell us right away if you believe someone has used your account without permission.

10. Reviews and other content you send us

If you submit a review, photo or comment, it must be honest, your own, and must not be unlawful or offensive or infringe anyone else’s rights. You give us permission to display, reproduce and share that content in connection with our business, free of charge. We may remove content that does not meet these rules.

11. Intellectual property

The content of this site, including the Newtronx name and logo, text, photos, graphics and product names, belongs to us or our licensors and is protected by intellectual property laws. You may use the site for personal, non-commercial shopping. You may not copy, reproduce or use our content for commercial purposes without our written permission. 12. Acceptable use

You agree not to misuse the site, including by attempting to gain unauthorized access, interfering with how the site works, using automated tools to scrape it, or using it for anything unlawful or fraudulent.

The site may contain links to websites we do not control, such as carrier tracking pages and social media. We are not responsible for their content or practices.

14. Privacy

Our Privacy Policy explains how we collect and use your personal information.

15. Disclaimer

Except for the limited warranty described in our Shipping & Return Policy, and to the fullest extent permitted by law, the site and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not promise that the site will always be available, uninterrupted or free of errors. Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

16. Limitation of liability

To the fullest extent permitted by law, Newtronx and Elaine and Associates, LLC will not be liable for indirect, incidental, special or consequential damages arising from your use of the site or from products purchased through it, and our total liability for any claim related to an order will not exceed the amount you paid for that order. Nothing in these Terms limits any liability or any consumer right that cannot be limited or waived under applicable law.

17. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. If you have a problem with an order, please contact us first so we can try to resolve it. Any legal action relating to these Terms or to your order must be brought in the state or federal courts located in Florida, unless applicable law gives you the right to bring it elsewhere.

18. Changes to these Terms

We may update these Terms from time to time. The version posted on this page when you place your order is the one that applies to that order. We will change the “Last updated” date at the top of this page whenever we make changes.

19. General

If any part of these Terms is found to be unenforceable, the rest remains in effect. If we do not enforce a provision, that does not mean we waive our right to do so later. These Terms, together with our Shipping & Return Policy and Privacy Policy, are the entire agreement between you and us about your use of the site and your orders.
